FDA Declines CBD Regulation

In recent news, the FDA announced that they would not regulate CBD products. But many in the industry want the agency to declare regulations for the marijuana industry in relation to these products and supplements. As CBD products have become more popular and in higher demand, the need to regulate them continues to grow.

The FDA is typically responsible for these types of regulations. However, they’ve thrown up their hands in a statement that there are too many unknown variables to be able to provide regulatory feedback.

Their stance has placed a responsibility back to Congress to set a basis for the rules. While this is primarily related to the CBD market in terms of food products, lotions, tinctures, and other similar items, it’s important to note that it will bring recognition directly to the marijuana industry.

These regulations and compliance details should incorporate professionals in the industry that are familiar with the use of marijuana and CBD for treatments and products in order to ensure any imposed regulations are appropriate for the industry.

The FDA argues that there simply isn’t enough evidence to know the safety values. And while testing has been limited, there are more and more research and studies being conducted that can be used to garner information.

Perhaps the time has come to make a more concerted effort to utilizing studies and research to better understand the marijuana and CBD market, as well as the potential benefits and treatments that they can provide.

Who steps in to make those decisions and ensure that they are in the best industry of the people, as well as the industry as a whole?

How does CBD affect us in Kentucky? It’s a multi-part concept. CBD products that are legal in all 50 states are required to contain less than .3% THC. But there are also CBD products that are marketed over that limitation.

While Governor Beshear’s executive order did provide for Delta-8 for medical uses, it did not touch on CBD with enriched levels of THC. At this time, Kentucky only allows CBD products that are below the .3% threshold still. However, there are a number of products available that fall into this category in Kentucky and other states across the country.
